Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the AnyBody mobile application, website (if applicable), and related services (collectively, the "Platform").

AnyBody is the consumer-facing brand of The Inclusive Collective FZ-LLC ("Company", "we", "us", or "our").

By accessing, registering on, or using the Platform, or placing an order, you confirm that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

1. Legal Entity and Contracting Party

All purchases, transactions, and agreements made through the Platform are entered into with The Inclusive Collective FZ-LLC, which is the sole legal contracting party responsible for:

  • Sale of products
  • Operation of the Platform
  • Processing of payments
  • Customer service and fulfillment

2. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction. By using the Platform, you represent and warrant that:

  • You have full legal capacity to enter into binding contracts
  • All information provided is accurate and complete
  • You will comply with applicable UAE law and these Terms

The Company reserves the right, at its sole discretion and where permitted by law, to refuse service, terminate accounts, restrict access, or cancel transactions.

3. Account Registration and Security

You may be required to create an account. You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Accept responsibility for all activity under your account

The Company reserves the right, at its sole discretion, to permanently suspend, terminate, or restrict accounts and block access to the Platform where necessary to protect the integrity of the Platform, prevent abuse, or enforce these Terms.

The customer is responsible for safeguarding account credentials and for all activity occurring under their account.

4. Products and Availability

All products are subject to availability. The Company reserves the right to:

  • Modify or discontinue products
  • Limit quantities per order or customer
  • Refuse or cancel orders

Product images and descriptions are illustrative only. The Company does not guarantee product fit, sizing suitability, or individual comfort.

5. Pricing and Payment

All prices are listed in United Arab Emirates Dirhams (AED) and include VAT where applicable.

The Company reserves the right to correct pricing errors, system errors, or technical errors at any time, including after an order has been placed.

Payment methods include approved third-party processors. Foreign transaction fees imposed by banks are the customer's responsibility.

VAT Invoices: The Company shall issue VAT-compliant invoices in accordance with UAE tax regulations where applicable.

6. Order Acceptance and Contract Formation

Order confirmation does not constitute acceptance of the order. A legally binding contract is formed only upon dispatch of the product.

The Company reserves the right to cancel orders at its sole discretion, including due to:

  • Fraud suspicion
  • Pricing or technical errors
  • Product unavailability

Approved refunds will be processed to the original payment method, unless otherwise required by applicable law. Refund processing is typically initiated within 7–14 business days after refund approval. The Company reserves the right to refuse, cancel, or delay any order prior to dispatch where fraud, unauthorized activity, or violation of these Terms is suspected.

7. Shipping and Delivery

Delivery timelines are estimates only and not guaranteed. The Company shall not be liable for delays caused by couriers, customs, or events beyond reasonable control.

Customers are responsible for providing accurate delivery information. If delivery fails due to customer unavailability, refusal to accept delivery, or incorrect address, the Company reserves the right to charge additional delivery or handling fees.

Delivery shall be deemed completed when the products are delivered to the delivery address specified in the order and confirmed by courier delivery confirmation, delivery photograph, OTP confirmation, signed receipt, or equivalent delivery verification.

For international deliveries, customers are solely responsible for any customs duties, import taxes, clearance charges, or regulatory requirements imposed by the destination country.

8. Title and Risk of Loss

Ownership of products shall transfer to the customer upon full payment and dispatch of the products by the Company or its authorized courier.

After confirmed delivery, the customer assumes responsibility for the products, except where liability arises from manufacturing defects, product defects, or statutory consumer rights under applicable UAE law.

The Company shall remain responsible for resolving delivery failures, non-delivery, or loss occurring prior to confirmed delivery, in accordance with applicable UAE Consumer Protection Law.

9. Returns and Exchanges

Returns and exchanges are governed by the Company's Returns Policy, which forms an integral part of these Terms. Products must be returned within 14 days of delivery and must be unused, unworn, and in original condition with tags intact. The Company reserves the right to refuse returns that do not meet these conditions.

Where a return or cancellation is approved, refunds will be initiated within 7–14 business days from the date the returned product is received and inspected by the Company. Refunds will be issued to the original payment method used for the purchase unless otherwise required by applicable law.

Unless the return is due to a defective, damaged, or incorrect product supplied by the Company, customers are responsible for return shipping costs.

Original delivery fees are non-refundable unless otherwise required by applicable law. Nothing in these Terms excludes, limits, or modifies any rights granted to consumers under applicable UAE Consumer Protection Law.

10. Fraud Prevention and Verification

The Company reserves the right to request identity verification, payment verification, or additional information before processing or delivering orders. Failure to provide requested verification may result in order cancellation. The Company may contest chargebacks and recover fraud-related losses.

11. Prohibited Use and Promotional Abuse

You agree not to misuse the Platform, including:

  • Fraudulent activity
  • Abuse of promotions
  • Resale without authorization

The Company reserves the right to cancel orders and suspend accounts involved in abuse. Products are intended for personal use only and may not be purchased for resale without prior written authorization from the Company.

12. Intellectual Property

All Platform content is owned exclusively by The Inclusive Collective FZ-LLC. Commercial use without written permission is prohibited.

13. Third-Party Services

The Platform uses third-party providers. To the fullest extent permitted by law, the Company shall not be liable for failures, errors, delays, interruptions, or security breaches caused by third-party providers beyond the Company's reasonable control.

14. Platform Availability and Modifications

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, the Company reserves the right to modify or discontinue the Platform.

15. Platform Errors and Technical Limitations

To the fullest extent permitted by applicable law, the Company shall not be liable for losses arising from platform outages, system errors, software bugs, integration failures, or pricing errors. The Company reserves the right to correct errors and cancel affected orders.

16. Disclaimer of Warranties

To the fullest extent permitted under applicable UAE law, the Platform, products, and services are provided on an "as is" and "as available" basis without warranties of any kind. Nothing in these Terms excludes, limits, or modifies any statutory consumer rights or warranties that cannot be excluded under applicable UAE Consumer Protection Law.

17. Limitation of Liability

To the fullest extent permitted by UAE law, the Company shall not be liable for indirect or consequential damages. The Company's total liability shall not exceed the purchase price paid by the customer for the relevant order.

18. Indemnification

You agree to indemnify the Company against claims arising from misuse of the Platform or violation of these Terms.

19. Force Majeure

The Company shall not be liable for delays caused by events beyond reasonable control.

20. Privacy

Use of the Platform is governed by the Privacy Policy.

21. Electronic Communications

You consent to receive communications electronically.

22. App Store Terms

Apple Inc. and Google LLC are not responsible for the Platform.

23. Assignment

The Company may assign or transfer its rights and obligations under these Terms without prior notice.

24. Severability

If any provision is invalid, the remainder remains enforceable.

25. Entire Agreement

These Terms constitute the entire agreement.

26. No Waiver

Failure to enforce any provision does not constitute waiver.

27. Governing Law and Jurisdiction

These Terms are governed by UAE law. Disputes shall be subject to the courts of Ras Al Khaimah, United Arab Emirates.

Dispute Resolution Process: Customers agree to first contact the Company's customer support and allow a reasonable opportunity for resolution before initiating formal legal proceedings. The Company shall make good-faith efforts to resolve disputes promptly and fairly in accordance with applicable law.

28. Language

In case of conflict, the English version shall prevail.
